Resolution approving and authorizing the City Manager to execute a legal services agreement with Sher Edling LLP to join a lawsuit filed by the County of San Mateo and other cities in the County against Monsanto to recover costs of remediating PCB contamination

WHEREAS, the County of San Mateo and other cities in the County have initiated a lawsuit against Monsanto for the costs of remediating PCB contamination, including anticipated costs of addressing contamination in stormwater runoff; and

 

WHEREAS, the County and other cities have retained Sher Edling LLP to represent them in the lawsuit; and

 

WHEREAS, the County and other cities have agreed to allow the City of South San Francisco to join the lawsuit as a plaintiff; and

 

WHEREAS, the City Council desires to join with the other plaintiffs in the case to seek recovery from Monsanto of the costs of remediating PCB contamination.

 

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of South San Francisco as follows:

 

1.                     The Legal Services Agreement with Sher Edling LLP, attached hereto as Exhibit A, is hereby approved.

2.                     The City Manager is hereby authorized to execute the attached Legal Services Agreement on behalf of the City of South San Francisco, subject to any minor modifications that are approved as to form by the City Attorney that do not substantially increase the City’s obligations hereunder.

3.                     This Resolution shall be effective immediately upon adoption.
