RECOMMENDATION

Recommendation

It is recommended that the City Council adopt a resolution approving a License Agreement with the San Mateo County Express Lanes Joint Powers Authority for a license to install, operate, and maintain facilities in the City’s Right-of-Way.

BACKGROUND/DISCUSSION

As part of the US-101 Express Lanes project constructed by the California Department of Transportation (“Caltrans”), the San Mateo County Express Lanes Joint Powers Authority (“SMCEL-JPA”) intends to install Express Lanes along US-101 with the intent to collect revenue to develop a Pilot Equity Program that responds to the transportation needs of historically underserved communities in San Mateo County and provide meaningful benefits to those communities. Some desired outcomes of the US-101 Express Lanes project are to improve the safety and connectivity of the active transportation network in the communities adjacent to the corridor and to encourage mode shift from single-occupancy vehicles to transit or other high-occupancy modes.

The SMCEL-JPA is seeking a License Agreement with the City to install support tolling equipment and facilities within the City’s Right-of-Way (“ROW”) in front of 300 Shaw Road. The approximate location of the facilities is shown in Attachment 1.

This License Agreement describes that the City allows the facilities to be installed in the City’s Right-of-Way(“ROW”) and that the JPA will be the owners and be entirely responsible for the installation and maintenance of the facilities.

The facilities have already been installed as part of an encroachment permit issued to Caltrans. Therefore, this License Agreement would be executed after-the-fact. The tolling equipment and facilities as installed are shown in Attachment 2.

 

FISCAL IMPACT

Approving the License Agreement will have no fiscal impact on the City.

 

RELATIONSHIP TO STRATEGIC PLAN

Approval of this License Agreement will support the City’s Strategic Plan outcome of improved Quality of Life SSF Priority Area 2, Initiative 2.2 by promoting mode shifts from single-occupancy vehicles to transit and other high-occupancy modes.

 

CONCLUSION

It is recommended that the City Council adopt a resolution approving License Agreement with the SMCEL-JPA, authorizing the recordation of the parcel map and all related documents.
