Resolution authorizing the City Manager to execute a Sublease Agreement for the commercial space located at 630 El Camino Real (Suite A) in South San Francisco for the purposes of continuing an existing commercial use (Milk Tea Lab).

WHEREAS, in 2019, Milk Tea Lab assumed an existing Sublease Agreement from Cool Tea Bar, LLC for the 1,600 square feet space and has continually operated at this location; and
WHEREAS, the term of the original Sublease Agreement ends in September 2021 and permits the owners to extend the term for another five years; and
WHEREAS, Milk Tea Lab wishes to continue operating at this location for another ten years and has requested that, rather than agreeing to an automatic five year extension, that they enter into a new ten-year Sublease Agreement; and
WHEREAS, Milk Tea Lab has been a good tenant and a stable business that anchors the three unit commercial space at 630 El Camino Real; and
WHEREAS, the City and Milk Tea Lab negotiated a new Sublease Agreement; and
WHEREAS, the City Council desires to enter into a Sublease that will allow the business to operate up to another ten years.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of South San Francisco hereby authorizes the City Manager, or his designee, to execute the Sublease Agreement substantially in the form attached as Exhibit A to this Resolution, and as a result of completed negotiations, to make any revisions, amendments, or modifications, deemed necessary to carry out the intent of this resolution which do not materially alter or increase the City's obligations thereunder, subject to approval as to form by the City Attorney.
BE IT FURTHER RESOLVED that this resolution shall take effect immediately.
