WHEREAS, the 2026 Street Surface Seal Project ("Project") will apply a protective surface treatment, commonly referred to as a surface seal or slurry seal, within the Winston Serra neighborhood, located in the northeastern part of the City; and

WHEREAS, the City issued a notice inviting bids for the project on March 18, 2026, and March 23, 2026, and on April 8, 2025, staff received six (6) bid proposals in response; and

WHEREAS, following the bid, the City received a timely bid protest letter from VSS International, Inc., against the apparent low bidder Dryco Construction, Inc.; and

WHEREAS, after carefully reviewing the bid protest and consulting with the City Attorney's Office, City staff determined that the bid submitted by Dryco Construction, Inc., the apparent low bidder, is responsive; and

WHEREAS, Dryco Construction, Inc. of Sacramento, California was the lowest responsible bidder and provided competitive unit prices; and

WHEREAS, staff recommends awarding the construction contract to Dryco Construction, Inc. of Sacramento, California in an amount not to exceed $3,031,894.22, which is the total for the base bid and alternative bid schedules; and

WHEREAS, staff also requests the City Council to authorize a construction contract authority budget of $3,031,894.22, with additional $454,784.13 contingency, totaling a construction budget of $3,486,678.35 for the Project; and
