Recommendation
It is recommended that the City Council adopt a resolution authorizing the City Manager to execute a Second Amendment to the Consulting Services Agreement with Swinerton Management and Consulting for construction management in an amount of $251,424 related to the Orange Memorial Park Aquatics Center Project and extend the contract period end date to December 31, 2027.

BACKGROUND/DISCUSSION
On May 11, 2022, the City entered into a Consulting Services Agreement ("Agreement") with Swinerton Management and Consulting ("Contractor") for professional construction management services for the Orange Memorial Park Aquatic Center project. A true and correct copy of the Agreement is attached to the Resolution as Exhibit A.
Following contract award in 2022, the Contractor commenced preconstruction and construction management services. Architectural design also began shortly after award of the Agreement. The project was bid in January 2024, and the construction contract was awarded to Wickman Development & Construction. Construction and construction-phase support services began in July 2024. On December 31, 2024, the City issued a First Amendment to the agreement extending the date for the term of services to December 31, 2026.
This Second Amendment to the agreement requests an additional fee of $251,424 in compensation to cover expanded and extended services, including:
