Linden Avenue reducing the total number of affordable units and modifying the income levels to include only very low-income units.

WHEREAS, on March 16, 2023, the Planning Commission of the City of South San Francisco approved a new 543-unit multi-family rental apartment complex located at 7 S. Linden Avenue; and

WHEREAS, the Conditions of Approval for the project included the following General Planning Division condition, "Prior to issuance of building permits, the applicant shall execute and record an Affordable Housing Agreement consistent with SSFMC Chapter 20.380, Inclusionary Housing Regulations;" and

WHEREAS, on March 11, 2025, the City and the property owner, Essex Portfolio, L.P. (Essex), entered into an Affordable Housing Agreement (AHA) implementing the requirements of South San Francisco Municipal Code Section 20.380; and

WHEREAS, the AHA requires Essex to provide 15% of the total number of units in their development (or 81 units) at below market rate rents and specifically that 10% of units (or 54 units) be offered at a rents affordable to low-income households and 5% of units (or 27 units) be offered at rents affordable to very low-income households; and

WHEREAS, a building permit for the project was issued on May 6, 2025, and the project is now under construction; and

WHEREAS, in a letter dated September 17, 2025, Essex requested that the City consider an amendment to its AHA changing the price calculation of a portion of the affordable units or reducing the overall number of affordable units; and

WHEREAS, the City now wishes to amend the AHA reducing the total number of affordable units from 81 to 54 and making all of the units very low-income units calculated at 50% of the area median income; and
