Resolution supporting H.R. 530 (Eshoo) to restore local control of 5G deployment and authorize the Mayor to sign a letter of support for H.R. 530 on behalf of the City Council
body
WHEREAS, On August 2, 2018 and September 26, 2018, the Federal Communications Commission (FCC) adopted regulations to limit the ability of cities and states to regulate small cell sites needed for the deployment of fifth generation (5G) wireless communication equipment; and
WHEREAS, The actions limit the type and amount of fees cities and states may charge, set “shot clocks” as low as 60 days for cities and states to authorize proposals, and limit non-fee requirements cities and states may institute; and
WHEREAS, The City of San Jose is leading the coalition of nearly 100 local governments from 22 states in suing the FCC arguing that the agency lacks the statutory authority to issue such regulations.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of South San Francisco hereby confirms the City’s commitment to overturn the Federal Communications Commission regulations and authorizes the Mayor to sign a letter of suppport on behalf of the City.
