Title

Resolution approving a side letter agreement amending Article 4 of the Memorandum of Understanding between the City and AFSCME Local 829

WHEREAS, the City contracts with the California Public Employees’ Retirement System (CalPERS) for pension benefits for all full-time regular employees, including employees represented by the American Federation of State, County and Municipal Employees (AFSCME) Local 829; and

 

WHEREAS, the City was recently informed by CalPERS representatives that the Communications Dispatcher education incentive described in by Article 4 of the Memorandum of Understanding between AFSCME Local 829 and the City did not meet Public Employee Retirement Law (PERL) requirements for reportable compensation; and

 

WHEREAS, the parties mutually desire to amend the current Memorandum of Understanding to comply with CalPERS requirements regarding reportable compensation while maintaining the mutual intent of the parties; and

 

WHEREAS, City staff met and conferred with AFSCME local 829 representatives and tentatively agreed on a side letter agreement amending Article 4 of the Memorandum of Understanding.

 

NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of South San Francisco does hereby approve the Side Letter Agreement amending Article 4 of the Memorandum of Understanding between the City and AFSCME Local 829, effective July 1, 2025-June 30, 2026, attached hereto as Exhibit A.

BE IT FURTHER RESOLVED that the City Manager is authorized to execute the Side Letter Agreement, including any minor amendments consistent with the intent of this Resolution that do not increase the City’s obligations, subject to approval as to form by the City Attorney.
