Resolution authorizing the City Manager to execute a Second Amendment to a Memorandum of Understanding (MOU) with the San Mateo County Transportation Authority (SMCTA), Peninsula Corridor Joint Powers Board (PCJPB), and the City of San Bruno, amending project scope and increasing the local match participation budget for the South Linden Avenue and Scott Street Grade Separation Project (Project No. st1004).

WHEREAS, on June 7, 1988, the voters of San Mateo County approved a ballot measure to allow the collection and distribution by the San Mateo County Transportation Authority (TA) of a half-cent transactions and use tax in San Mateo County for 20 years with the tax revenues to be used for highway and transit improvements pursuant to the Transportation Expenditure Plan presented to the voters (Original Measure A); and
WHEREAS, on November 2, 2004, the voters of San Mateo County approved the continuation of the collection and distribution by the TA of the Measure A half-cent transaction and use tax for an additional 25 years to implement the 2004 Transportation Expenditure Plan, beginning January 1, 2009 (New Measure A); and
WHEREAS, on November 7, 2013, the TA programmed and allocated up to $650,000 from the Measure A Grade Separation Program Category for the South Linden Avenue and Scott Street Grade Separation Project (“Project”) Study Report (PSR) through Resolution 2013-24; and
WHEREAS, the City of South San Francisco (“City”) and the City of San Bruno (collectively, “Sponsors”), collaborated with the PCJPB to complete the PSR in April 2021; and
WHEREAS, the Sponsors selected a preferred alternative for the Project and requested the TA provide $4,950,000 in funds to support the Preliminary Engineering/Environmental phase of the Project of the estimated $5,500,000 in costs for this phase; and
WHEREAS, the Project meets the intent of the 1988 Transportation Expenditure Plan, and the 2004 Transportation Expenditure Plan designates 15 percent of the New Measure A revenue to fund grade separation projects; and
WHEREAS, the TA, City, the City of San Bruno, and PCJPB are undertaking the next phase of the South Linden Avenue and Scott Street Grade Separation Project in that of the Preliminary Engineering/Environmental phase with PCJPB leading the request for proposals (RFP) efforts and administration of the consultant contract; and
WHEREAS, on March 3, 2022, through Resolution 2022-09, the SMCTA’s Board of Directors programmed and allocated up to $4,950,000 in Measure A Grade Separation Program Category funds for the Preliminary Engineering/Environmental (PE/ENV) phase (Scope of Work) of the South Linden Avenue and Scott Street Grade Separation Project (Project); and
WHEREAS, on August 22, 2022, the Parties entered into the MOU for the Project, which provided that the Scope of Work was to be completed no later than August 22, 2025; and
WHEREAS, April 15, 2026, the Parties entered into the First Amendment to the MOU to extend the time of performance to December 31, 2027; and
WHEREAS, on May 7, 2026, through Resolution 2026-13, the SMCTA’s Board of Directors programmed and allocated an additional $2,804,490 in Measure A Grade Separation Program Category funds and $860,625 in Measure A Caltrain Category Funds for the Scope of Work of the Project; and
WHEREAS, the Sponsors will contribute an additional $980,985 in local, state, federal, or other matching funds for the Scope of Work, of which $804,408 will be contributed by the City of South San Francisco (Lead Sponsor) and $176,577 will be contributed by the City of San Bruno (Co-Sponsor); and
WHEREAS, the Parties desire to amend the MOU to include the additional allocation of $3,665,115 Measure A Funds and additional commitment of $980,985 of local matching funds for the Scope of Work.
NOW THEREFORE BE IT RESOLVED, that the City Council of South San Francisco hereby takes the following actions:
1. Approves the Second Amendment to the Memorandum of Understanding (MOU) attached hereto and incorporated herein as Exhibit A between the City of South San Francisco, City of San Bruno, Peninsula Corridor Joint Powers Board (PCJPB) and the San Mateo County Transportation Authority (TA).
2. Authorizes the City Manager or authorized designee to execute the Second Amendment to the MOU on behalf of the City Council of the City of South San Francisco and San Bruno, in substantially the same form as Exhibit A, subject to approval as to form by the City Attorney.
3. Authorizes the City Manager or authorized designee to take any other related actions consistent with the intention of the Staff Report or this Resolution.
