Resolution authorizing designated City officials to execute Community Development Block Grant (CDBG) documents required by the U.S. Department of Housing and Urban Development (HUD) for current and future program years.

WHEREAS, the City of South San Francisco, California, is an Entitlement Community under the United States Department of Housing and Urban Development (HUD) Community Development Block Grant (CDBG) Program; and
WHEREAS, pursuant to Title I of the Housing and Community Development Act of 1974, as amended, HUD provides annual CDBG funding to eligible entitlement communities for activities that principally benefit low- and moderate-income persons, aid in the prevention or elimination of slums and blight, or meet urgent community development needs; and
WHEREAS, HUD regulations require the preparation and adoption of a Five-Year Consolidated Plan and an Annual Action Plan, which serves as the City's annual application for CDBG funding; and
WHEREAS, the City has prepared and adopted its applicable Consolidated Plan and Annual Action Plan in accordance with HUD requirements, including citizen participation, public notice, consultation, and comment requirements; and
WHEREAS, HUD requires the submission, execution, and certification of various documents in connection with the administration of the CDBG Program, including but not limited to Form SF-424, certifications and assurances, grant agreements, environmental certifications, amendments, performance reports, requests for release of funds, drawdown authorizations, and other documents necessary for the receipt, administration, expenditure, reporting, and closeout of CDBG funds; and
WHEREAS, the City Council finds that providing continuing authority to designated City officials to execute routine HUD-required applications, certifications, assurances, reports, and related documents will facilitate the efficient administration of the CDBG Program and ensure timely compliance with federal deadlines; and
WHEREAS, the City Council desires to authorize designated City officials to execute such documents on behalf of the City to ensure timely administration of the CDBG Program and compliance with HUD requirements.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of South San Francisco, California does hereby certify the following:
Section 1. Findings.
The foregoing recitals are true and correct and are incorporated herein by this reference.
Section 2. Authorization.
The City Manager, Assistant City Manager, Economic and Community Development Director, or their respective designees (collectively, the "Authorized Representatives"), are hereby authorized to execute and submit, on behalf of the City, all applications, certifications, assurances, agreements, reports, amendments, and other documents required by HUD in connection with the Community Development Block Grant (CDBG) Program, including but not limited to Form SF-424 and all related certifications and assurances required for submission of the Consolidated Plan, Annual Action Plan, Substantial Amendments, Consolidated Annual Performance and Evaluation Reports (CAPERs), grant agreements, and administration of CDBG funds.
Such documents include, but are not limited to:
• Form SF-424, Application for Federal Assistance;
• HUD Certifications and Assurances;
• Consolidated Plan submissions and amendments;
• Annual Action Plan submissions and amendments;
• Substantial Amendments and other Action Plan amendments;
• Grant Agreements and Grant Agreement Amendments;
• Environmental Review Record certifications and Requests for Release of Funds (RROF);
• Authority to Use Grant Funds certifications;
• Integrated Disbursement and Information System (IDIS) submissions and drawdown requests;
• Consolidated Annual Performance and Evaluation Reports (CAPERs);
• Performance reports and monitoring responses;
• Financial management certifications;
• Fair Housing, Civil Rights, and Equal Opportunity certifications;
• Section 3, labor standards, and other federal compliance certifications;
• Grant closeout documents; and
• Any other applications, certifications, assurances, agreements, reports, amendments, or related documents required by HUD for the receipt, administration, expenditure, reporting, amendment, or closeout of CDBG funds.
Section 3. Continuing Delegation of Authority.
The authority granted by this Resolution shall apply to the current Program Year and all subsequent CDBG Program Years unless modified or revoked by resolution of the City Council. No further annual authorization shall be required for the Authorized Representatives to execute and submit Form SF-424, HUD certifications and assurances, grant agreements, amendments, reports, or other HUD-required documents associated with the City's participation in the CDBG Program, provided such submissions are consistent with City Council-approved Consolidated Plans, Annual Action Plans, Substantial Amendments, appropriations, and applicable federal requirements.
Section 4. Further Authority.
The Authorized Representatives are further authorized to take such administrative actions and execute such additional documents as may be necessary or appropriate to carry out the purposes of this Resolution and to comply with applicable federal laws, regulations, and guidance governing the CDBG Program.
Section 5. Effective Date.
This Resolution shall take effect immediately upon adoption.
