Resolution approving a second amendment to Consulting Services Agreement with Biggs Cardosa Associates, Inc. of San Jose, California for the Bridge Preventive Maintenance Program (Project No. st1703) in an amount not to exceed $112,590 and authorizing a total budget of $400,000.

WHEREAS, the City of South San Francisco (“City”) adopted 2020-21 Capital Improvement Program (CIP) which includes Project No. st1703 for the Bridge Preventive Maintenance Program (“Project”) partially funded by the Highway Bridge Program (HBP) Grant; and
WHEREAS, the Project proposes repairs, identified in the Caltrans bridge inspection reports, for nine (9) bridges in the Bridge Preventive Maintenance Program (BPMP) package; and
WHEREAS, the Project requires professional consulting services for the engineering, environmental, regulatory agency permitting, design, construction management and related other services; and
WHEREAS, the City Council authorized a professional consulting services with Biggs Cardosa Associates, Inc. with a budget of $200,000, with additional $50,000 contingency, totaling a project budget of $250,000; and
WHEREAS, on May 10, 2021, the City executed a first amendment to the consulting services agreement by $31,666 for the additional of additional unidentified repairs not originally included in the initial scope of work; and
WHEREAS, the Project requires additional environmental process and permitting requiring additional professional consulting services for an additional $112,590 and $5,744 contingency; and
WHEREAS, the City’s standard consulting services agreement, attached hereto and incorporated herein as Exhibit A, has been reviewed and accepted by Biggs Cardosa Associates, Inc. with regards to the terms and conditions therein; and
WHEREAS, there are sufficient funds allocated in the City’s FY 2022-23 CIP for the proposed fees for the Project’s required services.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of South San Francisco that the City Council hereby approves an amendment to the consulting services agreement, attached herewith as Exhibit A, with Biggs Cardosa Associates, Inc. of San Jose, California in an amount not to exceed an additional $112,590, and authorizing a total budget of $400,000, conditioned on the Biggs Cardosa Associates, Inc.’s timely execution of the consulting services agreement and submission of all required documents, including but not limited to, certificates of insurance and endorsements, in accordance with the project documents.
BE IT FURTHER RESOLVED that the City Manager is hereby authorized to execute the second amendment in substantially the same form as Exhibit A and any other related documents on behalf of the City upon timely submission by Biggs Cardosa Associates, Inc.’s signed contract and all other documents, subject to approval as to form by the City Attorney.
BE IT FURTHER RESOLVED that the City Manager is hereby authorized to take any other required actions consistent with the intent of this resolution and accompanying staff report, that do not materially increase the City’s obligations.
