Resolution approving an agreement with Ross Recreation Equipment, Incorporated of Santa Rosa, CA for the purchase, construction, and installation of park amenities for the Dundee Park Remodel (pk2402) in an amount not to exceed $692,393 and approving Budget Amendment Number 26.021

WHEREAS, Dundee Park in the City of South San Francisco (“City”) is an approximately ¼ pocket park in the West Winston Manor neighborhood. The park has been well used for decades and is in dire need of repair and equipment replacement; and
WHEREAS, new furnishings and equipment are necessary at Dundee Park to replace features that are beyond their useful life, and it is to the benefit of the City and the public to pursue the Dundee Park Remodel Project (“Project”); and
WHEREAS, City staff proposes the use of a cooperative purchase program to contract for remodeling the park. While typically used for the installation of furniture, agencies are increasingly using these programs for the purpose of furnishings-related facility improvements; and
WHEREAS, South San Francisco Municipal Code sections 4.04.030 (specifically subdivision (k)) and 4.04.040 authorize the use of cooperative purchasing programs (referenced as “joint purchasing endeavors”) and agreements that are competitively bid or negotiated by other governmental agencies; the City’s Purchasing Policy similarly authorizes the use of cooperative purchasing schemes by showing the advantages of the cooperative purchase and that it would be made in conformance with California law and this policy. Relatedly, the City may piggyback on contracts if the contract terms are valid and have been negotiated by another governmental agency using a quote or bid process that substantially conforms to the procedures established by state law and the City purchasing ordinance; and
WHEREAS, City staff has identified and recommends use of National Purchasing Partners (“NPPgov”) to enter into an agreement with Ross Recreation Equipment, Incorporated. NPPgov is a Seattle, Washington-based national cooperative procurement organization offering publicly solicited contracts to government entities nationwide. NPP is the cooperative procurement organization, and the cooperative contract for park/playground equipment and related work is observed to be competitively solicited by the League of Oregon Cities through an RFP process that is consistent with what South San Francisco procedures would be; and
WHEREAS, the agreement with Ross Recreation Equipment would consist primarily of furnishing playground equipment, installation, and concrete work/surfacing. This scope of work would be appropriately characterized as furnishing of equipment and services, with incidental installation and construction work and therefore would be covered by the cooperative agreement scope. The new furnishings and equipment have been reviewed and accepted by the Parks and Recreation Department for their serviceability and mission usefulness; and
WHEREAS, the new furnishings and equipment has been reviewed and accepted by the Parks and Recreation Department for its serviceability and mission usefulness; and
WHEREAS, the new furnishings and equipment are anticipated to have an economic lifespan of a minimum of five years; and
WHEREAS, funding for the Project is included in the City of South San Francisco Capital Improvements Program (“CIP”) and additional budget appropriations of $300,000 are necessary to cover the purchase costs, which available in the Park Construction Fee Fund (Fund 806); and
WHEREAS, the new furniture and equipment will be purchased under an existing government “piggyback” contract under NPP Contract #PS21070; and
WHEREAS, staff has reviewed and confirmed the cooperative purchase contract is valid and in compliance with local, state and SSF purchasing procedures.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of South San Francisco that the City Council hereby approves an Agreement with Ross Recreation Equipment, Incorporated of Santa Rosa, CA, attached hereto and incorporated herein as Exhibit A, for the purchase, construction, and installation of park amenities for the Dundee Park Remodel (pk2402) in an amount not to exceed $692,393.
BE IT FURTHER RESOLVED that the City Manager is hereby authorized to execute the Agreement in substantially the same form as Exhibit A, and any other related documents, on behalf of the City upon timely submission of Ross Recreation Equipment, Incorporated’s signed contract and all other required documents, subject to approval as to form by the City Attorney.
BE IT FURTHER RESOLVED that the City Council approves Budget Amendment Number 26.021, which appropriates $300,000 of unassigned fund balance from the Park Construction Fee Fund (Fund 806); and
BE IT FURTHER RESOLVED the City Council authorizes a total Project budget of $850,000 and authorizes the City Manager to utilize unspent amount of the total Project, if necessary, towards additional contract contingency budget.
BE IT FURTHER RESOLVED that the City Council of the City of South San Francisco authorizes the Finance Department to establish the Project Budget consistent with the information contained in the staff report.
