Resolution awarding a construction contract to Dryco Construction, Inc. of Sacramento, California for 2026 Street Surface Seal Project (No. st2505, Bid No. 2708) in an amount not to exceed $3,031,894.22, authorizing a total construction contract authority budget of $3,486,678.35, and authorizing the City Manager to execute the agreement on behalf of the City; rejecting all bid protests and approving associated Budget Amendment Number 26.064.

WHEREAS, the 2026 Street Surface Seal Project (“Project”) will apply a protective surface treatment, commonly referred to as a surface seal or slurry seal, within the Winston Serra neighborhood, located in the northeastern part of the City; and
WHEREAS, the City issued a notice inviting bids for the project on March 18, 2026, and March 23, 2026, and on April 8, 2025, staff received six (6) bid proposals in response; and
WHEREAS, following the bid, the City received a timely bid protest letter from VSS International, Inc., against the apparent low bidder Dryco Construction, Inc.; and
WHEREAS, after carefully reviewing the bid protest and consulting with the City Attorney’s Office, City staff determined that the bid submitted by Dryco Construction, Inc., the apparent low bidder, is responsive; and
WHEREAS, Dryco Construction, Inc. of Sacramento, California was the lowest responsible bidder and provided competitive unit prices; and
WHEREAS, staff recommends awarding the construction contract to Dryco Construction, Inc. of Sacramento, California in an amount not to exceed $3,031,894.22, which is the total for the base bid and alternative bid schedules; and
WHEREAS, staff also requests the City Council to authorize a construction contract authority budget of $3,031,894.22, with additional $454,784.13 contingency, totaling a construction budget of $3,486,678.35 for the Project; and
WHEREAS, the Project is included in the City of South San Francisco’s fiscal year 2025-26 Capital Improvement Program (Project No. st2505); and
WHEREAS, the Project budget will be amended to include $350,000 of unallocated Citywide Traffic Impact Fee Fund; and
WHEREAS, the Project budget will be amended to include $200,000 of unallocated SB1 Fund.
NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of South San Francisco hereby awards a construction contract, a draft of which is attached hereto and incorporated herein as Exhibit A, for the Dryco Construction, Inc. of Sacramento, California, in an amount not to exceed $3,031,894.22 conditioned on Dryco Construction, Inc.’s timely execution of the Project contract and submission of all required documents, including, but not limited to, certificates of insurance and endorsement, in accordance with the Project documents.
BE IT FURTHER RESOLVED the City Council authorizes a total construction contract authority budget of $3,486,678.35 and authorizes the City Manager or their designee to utilize unspent amount of the total Project budget, if necessary, towards additional construction contingency budget.
BE IT FURTHER RESOLVED that the City Manager or their designee is hereby authorized to execute the construction contract in substantially the same form as Exhibit A and any other related documents on behalf of the City upon timely submission by Dryco Construction, Inc. of the signed contract and all other documents, subject to approval by the City Attorney.
BE IT FURTHER RESOLVED that the City Council hereby rejects all bid protests.
BE IT FURTHER RESOLVED that the City Council approves Budget Amendment Number 26.064, which amends the fiscal year 2025-26 Capital Improvement Program and hereby appropriates an additional $550,000 to Project st2505, supported by the following funding sources:
• $350,000 from the Citywide Traffic Impact Fee Fund
• $200,000 from the SB1 Fund
BE IT FURTHER RESOLVED that the City Council authorizes the City Manager or their designee to take any other related actions consistent with the intention of the resolution or the accompanying staff report.
