RECOMMENDATION

Recommendation

It is recommended that the City Council adopt a resolution amending the City’s Conflict of Interest Code to update the List of Designated Positions.

BACKGROUND/DISCUSSION

On August 12, 2026, the City Council accepted, by motion, the 2026 Biennial Notice (Notice) pursuant to the California Political Reform Act, as regulated by the Fair Political Practices Commission (FPPC). The Notice, prepared by the City Clerk, identified the need to amend the City’s Conflict of Interest Code to reflect changes in the City’s organizational structure, including the addition and elimination of positions, changes in position titles, and changes in assigned duties and responsibilities. Accordingly, the City Council, as the code-reviewing body, is required to amend the City’s Conflict of Interest Code within 90 days of filing the Notice.

 

Conflict of Interest Code Requirements and Recent History

The Conflict of Interest Code obligates a person holding a designated position in the City to file a Statement of Economic Interest Form 700 with the City Clerk; this is included in Attachment No. 1. The COI identifies designated positions whose duties involve making or participating in the making of governmental decisions that may foreseeably have a material financial effect on the filer.  The City’s list of Form 700 filers therefore includes both positions designated through the City COI Code and positions subject to statutory filing requirements with the Secretary of State.

 

In 2009, Resolution 22-2009 updated the disclosure categories to reflect changes to the Form 700 schedules, as included in Attachment No. 2. The most recent amendments to the COI were adopted on September 25, 2024, pursuant to Resolution 141-2024, as included in Attachment No. 3.

 

Current Recommended Amendments

The recommended changes to the List of Designated Positions are set forth in Attachment No. 4. No changes to the disclosure categories are recommended at this time.

 

CONCLUSION

It is recommended that the City Council adopt the proposed resolution amending the City’s Conflict of Interest Code.
