Title

Resolution approving a Third Amendment to an existing consulting services agreement with Swinerton Management and Consulting for construction management services of the Orange Memorial Park Aquatic Center project in an amount not to exceed $483,945, increasing the total contract authorization to $2,879,335 and authorizing the City Manager or designee to execute the amendment.

WHEREAS, on May 11, 2022, the City Council approved a Consulting Services Agreement with Swinerton Management and Consulting of San Francisco, California (“Consultant”) to provide construction management services for the Orange Memorial Park Aquatic Center Project (pk2310) in an amount not to exceed $1,946,060; and

 

WHEREAS, in February 2024, a construction contract was awarded to Wickman Development and Construction for the Orange Memorial Park Aquatic Center (pk2310), and

 

WHEREAS, a First Amendment to the Consulting Services Agreement was executed between City and Consultant on December 31, 2024, extending the date for the term of services to December 31, 2026, and

 

WHEREAS, the City Council approved a Second Amendment to the Consulting Services Agreement on February 25, 2025, increasing the total contract amount by $251,424 and

 

WHEREAS, Consultant has performed satisfactorily throughout the design and construction of the Orange Memorial Park Aquatic Center Project and has provided the services required under the Agreement; and

 

WHEREAS, the construction schedule for the Orange Memorial Park Aquatic Center Project has been extended, with substantial completion and project closeout now anticipated in early 2027, requiring continued construction management services during construction and closeout; and

 

WHEREAS, staff recommends approval of a Third Amendment to the Consulting Services Agreement with Consultant in an amount not to exceed $483,945 to provide continued construction management services through project completion; and

 

WHEREAS, as part of the adopted Fiscal Year 2026-27 Capital Improvement Program, the City increased the Orange Memorial Park Aquatic Center Project budget by $852,792 through the use of unspent bond sale proceeds from the Orange Memorial Park Sports Field Project (pk2309); and

 

WHEREAS, sufficient funding is available within the approved Orange Memorial Park Aquatic Center Project budget of $49,852,792 to fund the Third Amendment.

 

NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of South San Francisco hereby approves the Third Amendment to the Consulting Services Agreement with Swinerton Management and Consulting, attached hereto as Exhibit A, in an amount not to exceed $483,945, for a revised total contract authorization of $2,681,429.

 

BE IT FURTHER RESOLVED that the City Manager or designee is hereby authorized to execute the Third Amendment in substantially the same form as Exhibit A, and any other documents necessary to implement this Resolution on behalf of the City, subject to approval as to form by the City Attorney.

 

BE IT FURTHER RESOLVED that the City Council of the City of South San Francisco authorizes the Finance Department to establish the Project Budget consistent with the information contained in the staff report.
