Recommendation

Staff recommends that the City Council adopt a resolution conditionally approving the proposed access easement on City of South San Francisco property APN 015-190-180 to be granted for Sanfo Group for the future development of 101 Gull Drive, subject to Planning Commission approval of the applicable entitlements, and if so, authorizing the City Manager to execute an easement agreement.

BACKGROUND/DISCUSSION

Sanfo Group (“Developer) has proposed development of the empty lot located at 101 Gull Drive (APN 015-082-250) in the East of 101 Area. The development will construct a R&D building with an attached parking garage and various site improvements. The development is scheduled to be reviewed by the City’s Planning Commission on April 7, 2022 under P21-0006.

 

The site has frontage along Gull Drive; however, due to grading and existing landfill constraints, the most feasible location for driveway access to Gull Drive is through a City of South San Francisco (“City”) owned parcel (APN 015-190-180). The developer is required to obtain an access easement through the City parcel in order for the future development’s driveway to access the public right-of-way. See Attachment 1 for clarification of the proposed access easement’s location.

 

California Government Code section 65402 requires that, as a precondition to any disposition of real property, the City’s planning agency must determine that the location, purpose and extent of the proposed disposition are in conformity with the City’s General Plan. Pursuant to the Planning Department’s review, it has been concluded that the location, purpose and extent of the proposed access easement for the developer’s future driveway is in conformity with the City’s General Plan because (1) it fulfills the purpose of the project and underlying land use of the General Plan; (2) it provides the property with access to a public street; and (3) the amount of property being disposed of is necessary to construct the driveway as proposed.

 

There are certain community benefits from granting this non-exclusive easement to the 101 Gull Drive parcel. Specifically, the proposed easement improves connectivity in the Oyster Point Blvd., Eccles Ave. and Gull Drive area as there is currently no direct access from Gull Drive to the parcel hosting the 336-340 Oyster Point Blvd. and 584/560 Eccles Ave. sites. The location of the proposed access easement is also currently a sloped and unimproved area with no street frontage. The grant of access easement would permit the construction of an access driveway in the directional manner shown on Attachment 1, which would enhance connectivity from Gull Drive to the parcel without having the public traveling northbound on Gull Drive and turning into the site from Oyster Point Blvd. The easement also allows for improved frontage at this location associated with the construction of the driveway. Thus, the access easement serves a public purpose by accommodating such enhanced access and increased transportation capacity.

 

The developer will take their proposal to the Planning Commission meeting tentatively scheduled for April 7, 2022. To expedite approvals and the granting of the easement, staff recommends that the City Council conditionally approve the proposed access easement with the condition that Planning Commission approval of applicable entitlements be obtained prior to city execution of an Access Easement Agreement.

 

FISCAL IMPACT

This grant of easement will have no fiscal impact.

 

RELATIONSHIP TO THE STRATEGIC PLAN

Approving this easement will promote employment opportunities through the development of the empty lot per City Priority Area 2 Initiative 2.4.

 

CONCLUSION

Staff recommends that the City Council adopt a resolution conditionally approving the proposed access easement for Sanfo Group’s future development of 101 Gull Drive, on the condition that Planning Commission approval of applicable entitlements be obtained first and if so, authorizing the City Manager to execute an easement agreement.
