RECOMMENDATION
It is recommended that the City Council adopt a resolution authorizing the City Manager to execute the First Amendment to the Consulting Services Agreement with Construction Testing Services, Inc. for Special Inspection and Material Testing Services in an amount not to exceed $30,023.85 for consulting services related to the Civic Campus Phase 1: Police Operations & 911 Dispatch Center project.

BACKGROUND/DISCUSSION
Following the January 8, 2020 City Council award of a construction contract to Swinerton Builders for the Police Operations & 911 Dispatch Center project, on February 28, 2020 the City entered into a consulting services agreement with Construction Testing Services, Inc. (“CTS”) for special inspection and material testing services necessary for construction of the Civic Campus Phase 1: Police Operations & 911 Dispatch Center (“Police Station”).
The February 2020 agreement was executed in the amount of $149,908.25 by the approval of the City Manager at the recommendation of the Capital Projects Director. The current remaining balance on this agreement is $7,753.00. Staff anticipates the need for additional special inspection and material testing services through Spring 2021 in order to complete the regulatory and legal requirements laid out by the South San Francisco Building Department. After review and negotiation with CTS, staff determined that an additional $30,023.85 is sufficient to complete the scope of CTS’ work.
Typically, services provided by inspection firms are provided on a time and material basis because the scheduling and execution of their inspection work, while required by the City, is ultimately controlled by the contractor. With this amendment, CTS will continue to work with the Building Department to ensure that the new Police Station is built per contract documents and complies with all applicable building codes.
The City agreed to pay CTS a sum not to exceed $149,908.25 under the original Agreement entered into on February 28, 2020 to provide special inspection and material testing services. This contract amendment would increase the not-to-exceed number as summarized below:

FISCAL IMPACT
Funding for this amendment is included in the $56,857,615 budget for Police Operations & 911 Dispatch Center presented and approved by Council on January 8, 2020.

This effort is included in the City’s Strategic Plan. It aligns with Priority #2 which is focused on enhancing quality of life and Priority #3 which is focused on enhancing public safety.

Staff recommends City Council authorize the City Manager to execute the First Amendment to the Consulting Services Agreement with Construction Testing Services, Inc. for Special Inspection and Materials Testing Services.
