Resolution authorizing the City Manager to execute the Second Amendment to the Consulting Services Agreement with Akel Engineering Group, Inc. of Fresno California, for an additional $360,792, resulting in a total contract budget of $1,064,480, for the Sewer Master Plan (ss1801).

WHEREAS, the City of South San Francisco (“City”) adopted the fiscal year (FY) 2023-24 Capital Improvement Program (“CIP”) which includes Project No. ss1801 for the Sewer Master Plan (“Project”); and
WHEREAS, Akel Engineering Group, Inc. (“Consultant”) is the current design consultant for the City for the Project; and
WHEREAS, on January 24, 2018, the City and Consultant executed a Consulting Services Agreement in a total contract amount of $409,996 to develop the Citywide Sewer Master Plan, a copy of which is attached hereto and incorporated herein as Exhibit A; and
WHEREAS, on December 9, 2020, the City and Consultant executed a First Amendment to the Consulting Services Agreement and increase the contract authority by $293,692 for a total contract amount of $703,688, a copy of the amendment is attached hereto and incorporated herein as Exhibit B; and
WHEREAS, the design of the Project was originally anticipated to be complete by December 31, 2018; and
WHEREAS, due to additional design scope of services, the anticipated completion date is now June 30, 2027; and
WHEREAS, staff recommends additional scope for the current project to update the sewer model and master plan based on the City’s 2040 General Plan buildout and additional budget allowance for future analysis and updates; and
WHEREAS, staff recommends that the City execute a Second Amendment to the Consulting Services Agreement with the Consultant for an additional $360,792, resulting in a total contract amount of $1,064,480, with the understanding that $682,968.74 has already been paid; and
WHEREAS, there are sufficient funds appropriated in the City’s FY 2023-24 CIP for the consultant’s proposed fees for the Project’s required services.
NOW THEREFORE BE IT RESOLVED, that the City Council of South San Francisco hereby takes the following actions:
1. Approves the Second Amendment to the Agreement with Akel Engineering Group, Inc., attached hereto and incorporated herein as Exhibit C, extending the term to June 30, 2027 and increasing the contract amount by $360,792, resulting in a total contract budget of $1,064,480, with the understanding that $682.968.74 has already been paid.
2. Authorizes the City Manager to execute the Second Amendment with Akel Engineering Group, Inc. and to make any revisions, amendments, or modifications deemed necessary to carry out the intent of this resolution, which do not materially alter or increase the City’s obligations thereunder, subject to approval as to form by the City Attorney
BE IT FURTHER RESOLVED that the City Council of the City of South San Francisco authorizes the Finance Department to modify the Project Budget consistent with the information contained in the staff report.
BE IT FURTHER RESOLVED that the City Manager is hereby authorized to execute the agreements and any other related documents on behalf of the City upon timely execution by Akel Engineering Group, Inc. signed contracts and all other documents, subject to approval by the City Attorney.
BE IT FURTHER RESOLVED that the City Council of the City of South San Francisco authorizes the City Manager to take any other related actions consistent with the intention of the Staff Report and Resolution.
