Title

Resolution regarding approving the summary vacation of public storm drain easement for a storm drain main on the property APN 015-113-380 (100 Produce Avenue) due to storm drain main relocation.

WHEREAS, the 100 Produce Avenue (“Property”) project being developed by ICON SSF APARTMENTS OWNER, L.L.C. (“Developer”) has proposed to redevelop the existing 1.56-acre office lot into a new multi-family residential podium project with 184 residential units (“Project”); and

WHEREAS, there is an existing storm drain main and easement on the Property that impeded the mapping and construction of the residential building which the Developer was conditioned to relocate and grant a new storm drain easement for; and

WHEREAS, the existing 24-inch storm drain main is owned and maintained by the City, and it is located within an existing 10-foot-wide storm drain easement (via 1986 Instrument No. 86117795) and has since been removed and replaced by a new 24-inch storm drain main that is aligned along the Project’s internal parking lot as confirmed by City staff on April 4, 2026; and

WHEREAS, the new 24-inch storm drain main was installed in a new storm drain easement that was granted to the City (via DOC 2024-068245) as described in Attachment 2 to the accompanying staff report; and

WHEREAS, there are no remaining public storm drain facilities within this existing easement; and

WHEREAS, as City staff have determined the Easement to be superseded by relocation and no other public facilities are located within the Easement, the Easement may be summarily vacated pursuant to Streets and Highways Code section 8333; and

WHEREAS, the Easement to be vacated is described by plat and legal descriptions in Attachment 1 to the accompanying staff report.

THEREFORE, BE IT RESOLVED that the City Council of the City of South San Francisco hereby takes the following actions:

1.                     Approves of the summary vacation of the Public Storm Drain Easement located within the property APN 015-113-380 (100 Produce Avenue) as described in the accompanying staff report to this resolution and Exhibit A.

2.                     Authorizes the City Manager or designee to execute the necessary documents to effectuate the summary vacation of the Public Storm Drain Easement, subject to review and approval as to form by the City Attorney and take any other action necessary to accomplish the intent of this resolution.
